TERMS AND CONDITIONS OF SALE

2. General Provisions

These Terms and Conditions set forth the conditions for purchasing goods from the online store, as well as the rights and obligations of the Buyer and the Seller.

Only new physical goods are sold in the online store:

boats and vessels;

boat engines;

boat electronics, depth finders, and audio equipment;

fishing gear and accessories.

Pre-orders are not accepted.

By placing an order, the Buyer confirms that they have read and agree to these Terms and Conditions.

3. Products and Prices

All prices are listed in euros (EUR) and include VAT.

The price applicable to the order is the price in effect at the time the order is placed.

The Seller reserves the right to change prices without prior notice.

Product photos are for illustrative purposes only and may differ slightly from the actual product.

4. Conclusion of the Contract

The Buyer places an order and selects a payment method.

The contract is considered concluded when:

The buyer makes the payment;

The seller sends an order confirmation via email.

If payment is not made, the contract is not concluded.

5. Payment Terms

Available payment methods:

Online banking (via Paysera);

PayPal;

Credit/debit cards (Visa, Mastercard).

Payments are processed through certified payment service providers.

The Seller does not collect or store credit/debit card information.

All payment data is transmitted using secure SSL encryption protocols.

The transaction may appear on your bank statement under the company name “Albatros prekyba.”

6. Delivery

Goods are delivered in Lithuania and EU countries.

Delivery partners: DPD and Lietuvos Paštas.

Delivery times:

Lithuania: 1–2 business days;

EU: 2–5 business days.

Boats and rafts are delivered only to a designated pickup location, with the time arranged in advance.

Title and the risk of accidental loss pass to the Buyer upon delivery of the goods.

If the shipment is damaged, the Buyer must note this on the delivery documents and immediately inform the Seller.

7. Right to Cancel the Contract (14 Days)

The Buyer has the right to cancel the contract within 14 calendar days of receiving the goods without providing a reason.

The Buyer must notify the Seller of the withdrawal by email.

The returned item must be:

unused;

in its original packaging;

in saleable condition;

complete with all parts.

The Seller will arrange and pay for the return shipping.

A refund will be issued within 14 calendar days of receiving the returned item.

The refund will be issued via the same payment method used for the original purchase.

8. Defective Goods

If the item is defective, the Buyer has the right to request:

a replacement;

a price reduction;

a refund.

Defects must be reported immediately.

In the event of a dispute, an independent expert assessment may be conducted.

9. Refund Policy

Refunds are issued only after the goods have been returned and inspected.

Refunds are issued only to the same payment method used at the time of purchase.

The Seller reserves the right to withhold the refund until the item has actually been received.

In the event of an unjustified chargeback, the Seller reserves the right to provide the payment service provider with all evidence of the transaction.

10. Limitation of Liability

The Seller is not liable for indirect or incidental damages.

The Seller is not liable for damage resulting from improper use of the goods.

The Seller’s liability shall not exceed the amount paid for the goods.

11. Force Majeure

The Seller shall not be liable for failure to perform its obligations if such failure resulted from circumstances beyond its control (force majeure), including, but not limited to: natural disasters, war, strikes, logistical disruptions, and restrictions imposed by government authorities.

12. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the Republic of Lithuania.

Disputes shall first be resolved through negotiation.

If no agreement is reached, the consumer may contact the State Consumer Rights Protection Authority or use the European Commission’s online dispute resolution platform:

https://ec.europa.eu/odr

Disputes shall be finally resolved in the courts of the Republic of Lithuania.

13. Final Provisions

The Seller reserves the right to amend these Terms and Conditions.

The version of these Terms and Conditions in effect at the time the order is placed shall apply to that order.
